Terms and Conditions

  1. GENERAL PROVISIONS 

1.1 The following terms (both singular and plural) shall have the following meanings in these General Terms and Conditions: 

  1. General Terms and Conditions: these General Terms and Conditions of the Astra Film Festival (hereinafter referred to as AFF); 
  2. Visitor: a party that enters into an Agreement with AFF to participate in an Event 
  3. Event: a public or private event, such as, but not limited to, a performance of an artistic nature, including, but not limited to, a film screening, an exhibition, and/or a live event organized by AFF;
  4. Venue: the location where an Event takes place;
  5. Organizer: the party responsible for the production and/or organization of an Event; 
  6. Agreement: the agreement between AFF and you as a visitor and/or purchaser of one of AFF’s products; 
  7. Parties: the Visitor and AFF jointly; 
  8. Transaction number: the number associated with a specific Visitor or purchase, which must be mentioned in the purchase confirmation to enable exchange for a ticket or part of a ticket; 
  9. Products: all products offered by AFF
  10. Ticket: an admission ticket to an Event; 

1.2 These General Terms and Conditions apply to and form an integral part of every reservation and/or purchase of products by the visitor.

1.3 In the case of events, the agreement is also subject to the general terms and conditions of the owner of the relevant location. In the event of a conflict between the provisions of the agreement or these general terms and conditions and the terms and conditions referred to in the previous sentence, the provisions of the agreement or these general terms and conditions shall prevail. 

1.4 The applicability of any general terms and conditions of the visitor, including general terms and conditions of purchase, is hereby expressly rejected. 

  1. PAYMENT METHODS 

The following payment methods are possible: 

  1. When purchasing tickets online, via: Maestro, Mastercard, as well as alternative payment methods (PayPal, Apple Pay, Google Pay). 

Tickets and passes can also be purchased from the festival ticket office, payment can be made in cash or by bank card.

  1. CONCLUSION OF THE CONTRACT 

3.1 The contract is definitively concluded upon payment by the methods described above, if and as soon as AFF has received payment from the Visitor or payment authorization. The Visitor immediately receives confirmation of the purchase by email. 

3.2 It is not possible to modify, cancel, or terminate a definitively concluded agreement regarding tickets. 

  1. TICKETS AND SUBSCRIPTIONS

5.1 Tickets provided by AFF are and remain the property of AFF. Tickets are provided by AFF to the visitor on the condition that, without the prior written permission of AFF, the visitor shall not at any time be entitled to: 

  1. resell the tickets to third parties or provide the tickets in any other way, directly or indirectly, to third parties for commercial purposes; 
  2. offer the tickets in commercial communications in any way or refer to the tickets in any other way. 

5.2 AFF reserves the right to refuse at any time reservations from visitors who are suspected or have been found guilty of violating the above prohibition.

5.3 If a maximum number of tickets that can be reserved for an event has been set, AFF reserves the right to cancel reservations that exceed this maximum number for excess tickets reserved.

5.4 Each visitor to an event must have a valid ticket.

5.5. In the case of season tickets, visitors are required to reserve their seat in advance by purchasing a ticket with a value of 0. If the visitor has not completed this step, AFF reserves the right to refuse them access to the screening.

  1. CHANGES/CANCELLATIONS

6.1 AFF has the right at any time to move and/or otherwise modify the Event, in whole or in part. If the Event is moved and/or otherwise modified by AFF, the Ticket will remain valid for the modified Event and/or the new Location where the Event will take place. If AFF issues new tickets for the modified Event and/or the new location, the Visitor’s Ticket will become invalid. In the event of relocation and/or modification of the Event, the Visitor will have the right to return the Ticket to AFF in order to receive a refund of the Ticket price paid. A Visitor wishing to do so must return the ticket intact to AFF within no more than 5 (five) business days from the date on which the Event was scheduled to take place. 

6.2 AFF has the right at any time to cancel the Event in whole or in part. If the event is canceled by AFF, the visitor will be entitled to return the ticket to AFF in order to receive a refund of the ticket price paid. A visitor who wishes to do so must return the ticket intact to AFF within a maximum of 5 (five) working days from the date on which the event was scheduled to take place. 

6.3 If the relocation or cancellation of the event is the result of force majeure, the provisions of Article 7.7 shall apply. 

  1. LIABILITY

7.1 In the event that and to the extent that the Event is canceled by AFF, the Organizer, or the owner of the Venue, AFF shall not reimburse the Visitor for more than the price of the Tickets, to the extent that it has been demonstrably paid to AFF. Any additional costs paid by the Visitor for AFF services will not be refunded. In such cases, AFF will never accept liability for any other direct or indirect damages, costs incurred, and/or expenses. 

7.2 AFF shall never be liable for damages resulting from death, injury, accident, harm, loss, damage, or theft caused to the Visitor during or as a result of visiting the Event or the Venue. 

7.3 AFF shall never be liable for errors in offers, program content, announcements, communications or other information, quotes and/or tickets provided by AFF and third parties to the Visitor. 

7.4 If the Visitor or any third party involved suffers damage as a result of AFF’s failure to fulfill its obligations under the Agreement, AFF shall only be liable for direct damages and only if the damages in question are the result of gross negligence or intent on the part of AFF or its staff. 

7.5 If AFF is obliged to pay compensation on the basis of a defect, its liability shall be limited to the cost of the ticket paid by the visitor. 

7.6 AFF’s liability for damage resulting from work performed by third parties on behalf of the visitor, carried out on AFF’s instructions, is limited to the amount that the third party in question owes AFF as compensation. AFF will do everything that can reasonably be expected of it, and the Visitor will provide all cooperation that can reasonably be expected of him, to obtain the maximum possible compensation from the third party concerned. 

7.7 In the event and to the extent that AFF is unable to perform its obligations to the Visitor, in whole or in part, as a result of a force majeure event, the Agreement shall be terminated without either party being entitled to any compensation as a result thereof. 

7.8 The term “force majeure” includes, among other things: war, terrorist threats, danger of war and riots, epidemics, restrictive measures imposed by Romanian government agencies and foreign governments, fires, strikes, equipment and operating system failures and damage, traffic congestion, transportation strikes, floods, blockages, sabotage, and, in general, all unforeseen circumstances both in Romania and abroad, as a result of which AFF can no longer reasonably be expected to comply with the agreement. 

7.9 AFF assumes no liability for indirect damages, damages caused by the loss of Products, Tickets, or parts thereof, regardless of the reason. 

7.10 The Visitor shall be liable for all damages caused to the Venue, equipment, guests, staff, and/or third parties, caused by the actions of the Visitor and/or persons present at or near the Venue on behalf of the Visitor. 

  1. INTELLECTUAL PROPERTY RIGHTS 

8.1 All intellectual property rights relating to the name, logo, and any text and music of AFF, including advertising music, as well as those relating to the business formula used by AFF in general, are owned by AFF. The visitor is not entitled to make them public, directly or indirectly, and/or to reproduce or use them in any other way or to create links to them, unless they have the prior written consent of AFF. 

8.2 All intellectual property rights relating to the name of the Event, location, logos, and the like are owned by AFF, the Organizer, the original owners of the rights to the Event in question, and/or the owner of the location. Visitors are not entitled to make them public, directly or indirectly, and/or reproduce or use them in any other way or create links to them, unless they have the prior written consent of the relevant rights holders. 

  1. RULES OF CONDUCT 

During a visit to an Event, Visitors must behave in accordance with the law and social norms and must follow the directions and instructions of security personnel and other staff members. Visitors must also comply with the applicable rules of conduct relating to the event and the venue, such as, but not limited to:

  1. It is prohibited to bring photographic, video, audio, and/or other recording equipment into the venue. Visitors are also not permitted to have their mobile phones turned on during performances. If and to the extent that such equipment is nevertheless found, AFF or the owner of the Venue reserves the right to confiscate such equipment at any time and to refuse the Visitor access to the Venue, without the right to a refund and/or compensation; 
  2. It is prohibited to bring food, beverages, glassware, plastic or glass bottles, cans, fireworks, weapons, and other dangerous items to an Event and/or the Venue. The Organizer and the owner of the Venue reserve the right to search Event Visitors at any time upon entering the Venue. AFF, the Organizer, and the Venue owner reserve the right to refuse access to the Venue to any Visitor who refuses to cooperate with the above-mentioned search and/or who violates the above-mentioned prohibition, without the right to a refund and/or compensation; 
  3. AFF and the owner of the Venue reserve the right to refuse Visitors access to the Event at any time, without the right to a refund and/or compensation, if and to the extent that it is found that the Ticket was not obtained through AFF or other (pre)sale addresses authorized by AFF; 
  4. AFF and the venue owner reserve the right to refuse access to the venue at any time to visitors arriving after the start of the event, without the right to a refund and/or compensation; and/or
  5. AFF and the venue owner reserve the right to make or commission video and/or audio recordings of the event. The visitor declares that they are familiar with and agree to the above and hereby waives the right to object to the use of their portrait/image in the context of the publication and reproduction of the aforementioned recordings. 
  6. ADDITIONAL PROVISIONS

10.1 If any provision of the General Terms and Conditions or the Agreement becomes invalid or unenforceable or is voided, the General Terms and Conditions or the Agreement shall remain in force in all other respects. In such cases, the parties shall agree on a provision regarding the invalid or void article that most closely approximates the intentions of the parties in the Agreement or the General Terms and Conditions. 

10.2 Additions or amendments to the Agreement or the General Terms and Conditions may only be made in writing. 

10.3 Any complaints from the Visitor regarding the services provided by AFF must be addressed in writing to AFF’s customer service department at aff@astrafilm.ro, which will process them within two weeks. 

10.4 All disputes arising from the Agreement or the General Terms and Conditions shall be settled in accordance with Dutch law and shall be brought in the first instance before the competent court in Sibiu County, Romania.
